Historic Youth Climate Trial Begins in Vancouver as 15 Young Canadians Confront Federal Government in Court Over Charter Right Violations

After seven years of legal proceedings, youth plaintiffs will have their case heard in Federal Court, seeking protection from government conduct contributing to the climate crisis

VANCOUVER, British Columbia, Oct. 26, 2026 (GLOBE NEWSWIRE) — Today, La Rose v. His Majesty the King, a constitutional challenge brought by 15 young Canadians, begins in Federal Court in Vancouver, marking the first federal youth-led climate trial in Canadian history. The plaintiffs are represented by counsel at Arvay Finlay LLP and Webster Hudson & Coombe and supported by Our Children’s Trust and West Coast Environmental Law.

After seven years of legal proceedings, the young Canadians will finally have their case heard at trial, arguing that the federal government’s conduct contributing to the climate crisis violates their constitutional rights to life, liberty and security of the person under Section 7 of the Canadian Charter of Rights and Freedoms.

Filed in 2019, the case challenges both what the federal government has actively done, including subsidizing fossil fuel industries and approving major new extraction projects, and what it has repeatedly failed to do: meet its own greenhouse gas emissions reduction commitments and protect its citizens from what the government has declared to be a climate emergency. The plaintiffs argue that the government’s conduct has contributed to the climate crisis, causing serious and significant harm to their lives and futures.

For the young Canadians bringing the case, these impacts are already harming their lives. From displacement caused by wildfires and flooding to worsening health conditions and disruptions to Indigenous cultural practices, the plaintiffs’ experiences reflect the dire consequences of the climate crisis.

“I was 13 when I joined this case. I have grown up in it, and for seven years it has been part of my life, through all the ups and downs. To finally be here is more than I can put into words. I am excited, I am a little nervous, and I am proud of the fifteen of us for getting this far. The climate crisis is harming us now. We deserve protection. We deserve a future we can believe in. And our rights are worth standing up for,” said Sadie Vipond, youth plaintiff from Calgary, Alberta.

The plaintiffs are asking the Federal Court to declare that the government’s conduct violates their rights under Section 7 of the Charter and order the development and implementation of a science-based Climate Recovery Plan to reduce Canada’s greenhouse gas emissions and decarbonize its energy system in line with what scientists say is necessary to restore and maintain a Safe Climate System.

“This case is about the most fundamental Charter rights of children and youth – the right to life liberty and security of the person. The question for the Court is not what Canada’s climate policy should look like, but whether the government’s conduct is consistent with the Constitution,” said Catherine Boies Parker, K.C., counsel for the plaintiffs at Arvay Finlay LLP.

The trial follows years of procedural challenges, including a unanimous 2023 Federal Court of Appeal decision allowing the case to proceed. In a June 2026 ruling, Federal Court Justice Fothergill described the case as “a matter of considerable public importance, not only because of the factual context but also because of its constitutional implications,” adding that if the youth plaintiffs succeed, “the impact of this case may be profound.”

The evidentiary stage of the trial is scheduled to run from October 26 through November 20, 2026, during which the Court will hear directly from the youth plaintiffs, alongside expert witnesses in climate science, children’s health, renewable energy, climate policy and economics. The case raises significant questions about the relationship between constitutional rights and climate accountability, with the potential to shape how Canadian courts understand these issues for years to come.

“The question is not whether children belong in the courtroom. It is whether we are willing to listen to them when they speak. Constitutional rights do not begin at voting age. These young people will live the longest with today’s climate decisions, and they have the right to ask the courts to protect their futures,” said Andrea Rodgers, Deputy Director, Our Children’s Trust.
