Edmonton judge rejects ‘unhinged’ sentence proposed for Indigenous stabber

An Edmonton judge has rejected a joint sentence recommendation as “unhinged” for an Indigenous man who stabbed a stranger in the buttocks during a group mugging less than two months after he was released on bail on conditions prohibiting him from possessing any weapons.

Shaye Riley Bird, who still had the bloody knife on him, as well as blood on his pants when police picked him up, pleaded guilty in Alberta’s Court of Justice to the May 3, 2026, assault causing bodily harm and breaching the conditions of his release in March. Both his defence lawyer and the Crown recommended Bird get 180 days in jail for the assault, and another 30 days to be served concurrently, for the bail breach.

“This case features several errors in principle. They result in a proposition that constitutes one of those rare instances — a joint submission that is unhinged from what would be reasonable,” Justice Steven Bilodeau wrote in an Oct. 21 decision.

The judge concluded he could not accept the recommended sentence for three reasons.

“First, it does not adequately reflect the gravity of this random group attack with a knife,” Bilodeau said.

“Second, it gives no meaningful effect to the serious and lasting impact upon the victim. Third, the proposed concurrent sentence leaves the separate breach of the weapons condition without any meaningful sanction.”

Instead, the judge sentenced Bird to 18 months in jail — 14 months for the assault and another four months for the bail breach to be served consecutively — tripling the recommendation from defence and Crown lawyers, while noting “it is no small thing” to reject their joint submission.

Bird’s “conduct bears many of the hallmarks of a street mugging,” Bilodeau said. “It has been long-settled law in Alberta that these merit significant incarceration if they are to be deterred effectively, if at all.”

The attack was “perpetrated by a group or mob,” said the judge. “Being outnumbered changes the entire dynamic of the assault.”

The bail breach would have been serious if Bird had “merely been found carrying a pocketknife,” Bilodeau said. “Instead, he was found with what was effectively a hunting knife, covered in the victim’s blood, which he admits he used to stab the victim. It is hard to imagine a more significant breach of the order.”

The court heard that Bird was with a group of other people at Churchill Square on the evening of May 3. They approached a man wearing headphones at 9:12 p.m. and attacked him.

“During this assault the victim was stabbed with a knife in his buttocks causing a one-inch wound that bled heavily. The assailants took the victim’s headphones, which were worth about $100, and fled the scene,” the judge said.

The victim immediately reported the stabbing to police, who identified Bird through surveillance video.

“A search of the downtown area quickly located him still wearing the clothing described by the victim and seen in the video,” said the decision. “He was in possession of the bloody knife and had blood clearly on his pant leg.”

The victim told court that the attack affected him “emotionally” and changed how he interacts with Edmontonians.

He had just moved to Edmonton five days before the attack and now suffers from post-traumatic stress disorder.

“I walk around the city with fear and distress all the time since it was an unprovoked action,” the victim said.

Bird, 23, has done time for a May 2025 assault and for being in possession of a weapon for a dangerous purpose this past January. His lawyer “highlighted” Bird’s Indigenous background, the judge noted.

His family belong to the Paul Brand First Nation, part of the Cree Nakoda Nation near Duffield, Alta.

An Indigenous Background Report described how Bird “feels very connected to his Indigenous roots,” said the decision.

For Bird, “returning there is an important part of his stated plan, and he intends to reconnect with his family, culture, and establish greater stability within his community.”

Bird, who grew up mostly living with his family and six siblings, “described alcohol and substance use as a regular part of their growth years. There was also some domestic turmoil which could get physical.”

Bird’s mother described him as being the “man of the house,” after she separated from her husband.

“He was exposed to despicable racist attitudes surrounding his community, sufficient to drive him out of playing hockey, which he used to love playing. This also crept into his school life.”

That had an impact on Bird’s self-confidence, according to his mother and grandmother.

“It drove him to using marijuana and alcohol, and he eventually withdrew from school altogether in Grade 11.”

Bird’s mother and her parents attended residential schools, said the decision.

“The consequences of the treatment and derision that they underwent transposed into alcohol struggles and, as (his mom) puts it, part of an ongoing ‘family cycle.’ They were stripped of their cultural identities and traditional ways. These were not passed down the generations, and that negatively impacted all of them.”

The judge noted that he’s directed by Gladue principles set out in a Supreme Court of Canada decision that say sentencing judges must consider the unique circumstances of Indigenous offenders, as well as systemic issues like the impact of residential schools.

“In considering Mr. Bird, there can be no doubt that the effects of colonialization have impacted his family and made their way through the generations onto him,” Bilodeau said. “He described his response to the racism and discrimination. He said that he turned into a bully himself as a sort of defence mechanism.”

While the judge said he could see that Bird is not a fundamentally dangerous person, he needs “further persuasion that the prior convictions and sentences did not achieve.”

The judge saw it as “concerning” that Bird’s “short-term plan” was to embrace his “support from his family, community, and nation,” then return to Edmonton.

“It seems that as soon as he can, he wants to divert back to the environment which gave him the opportunity to consort with other bullies,” Bilodeau said.
