The National Basketball Association announced agreements with the Commodity Futures Trading Commission, Kalshi and Polymarket on October 26, expanding its role in prediction markets. The league signed an information-sharing agreement with the federal derivatives regulator and named both companies its preferred prediction market exchanges.
The arrangements introduce limits on NBA-related contracts, restrictions on personnel participation and procedures for reporting suspicious activity. They also distinguish the NBA from the National Football League, which has declined a similar arrangement.
NBA Signs CFTC Agreement to Protect Market Integrity
The NBA's memorandum of understanding with the CFTC establishes cooperation over NBA prediction markets and related event contracts. These contracts let participants predict whether a specified event will occur.
The CFTC oversees federally regulated exchanges that offer such contracts. Under the new agreement, the NBA and the regulator will share information to identify potential market misconduct.
The league follows Major League Baseball and the National Hockey League, which previously entered similar arrangements with the agency. Together, these agreements connect three major sports organizations with the federal prediction market framework.
Scott Kaufman-Ross, the NBA's head of media distribution and partnerships, said cooperation with regulators and operators can help establish safeguards. He also described the partnerships as a framework for new forms of fan engagement.
CFTC Chairman Mike Selig called the agreement a measure against insider trading and fraud. His agency has pursued rules and legal action over federal authority on event contracts.
Kalshi and Polymarket Face Trading Restrictions
Under their new preferred exchange status, Kalshi and Polymarket will cooperate with the NBA on market integrity. The agreements restrict which NBA-related contracts the platforms may offer.
They prohibit league and team personnel from trading NBA event contracts. The restriction addresses the risk of insiders participating in markets tied to games.
Kalshi said its agreement includes exchanging integrity data, flagging suspicious activity and assisting investigations. Such cooperation gives the league access to information that could help it examine questionable market behavior.
The partnerships follow a major federal gambling investigation from October 2025. Authorities arrested Miami Heat guard Terry Rozier and a coach over alleged involvement in gambling schemes.
The allegations included efforts to influence wagering through game-related misconduct. The cases brought attention to the potential misuse of privileged information and attempts to manipulate sporting outcomes.
The NBA's new restrictions apply to the prediction market contracts covered by these partnerships. They do not resolve the criminal allegations arising from the earlier investigation.

NBA Deal Deepens Divide Over Federal and State Oversight
The agreements arrive during a legal dispute over who should regulate sports-related prediction markets. The CFTC maintains that qualifying event contracts fall under federal derivatives rules.
Several state governments argue that these products amount to gambling and should follow state laws. Three major federal court decisions have reached differing outcomes, with two favoring the states' position.
The NFL has taken a different approach from the NBA. It declined a comparable agreement and supported a request for the Supreme Court to consider the jurisdictional dispute.
In its filing, the NFL criticized federal oversight as understaffed and less demanding than state gambling regulation. The league argued that prediction platforms lack equivalent regulatory safeguards.
Can federal market rules and state gambling protections coexist as sports prediction contracts expand? The unresolved dispute places the leagues' different responses within a broader debate over regulatory authority.
Meanwhile, the CFTC has moved to classify eligible event contracts as swaps under federal oversight while excluding casino-style gambling. That position forms part of its wider effort to define the regulator's responsibilities.
The commercial stakes are attracting attention. Bernstein analysts project prediction markets could generate billions in revenue from these products by decade's end. Blockchain.com has also sought CFTC approval to offer event contracts, adding another prospective participant to the market.
Conclusion
The NBA's CFTC agreement and partnerships with Kalshi and Polymarket establish safeguards for NBA event contracts. The NFL remains opposed to the current federal approach, while states challenge the regulator's authority. Legal disputes and oversight decisions will shape how these markets operate.
