Charges against the accused
According to the particulars of the charge, the five suspects, acting jointly with others not before the court, murdered Mathew Kyalo Mbobu on September 9, 2025, at around 7.30pm along Magadi Road in Karen, within Lang'ata Sub-County, Nairobi.
The two police constables charged alongside Mbithe and her children, Chris Mulwa and Angela Mulwa, are Julius Kipkoech Cheruiyot and Kennedy Kipkemoi Borboroi.
Before his death, Mbobu served as an advocate of the High Court, a university lecturer, and an author.
Second murder case for Rose Mbithe
The murder charge constitutes a second such case against Mbithe and her two children. The trio is already facing separate charges in connection with the death of Dr. Victoria Mutiso.
The prosecution also informed the court of its intention to charge police inspector Kenneth Sang in relation to the same murder.
Sang was arrested in Eldoret and subsequently brought before the Milimani Law Courts, where a court authorised his continued detention for 14 days to allow the Directorate of Criminal Investigations (DCI) to complete its investigations.
The court directed the prosecution to file an affidavit opposing the release of the accused persons on bond and set November 24, 2026, as the date for the hearing of the bond application.
Were Victoria Mutiso's killers paid?
In related news, investigation into Mutiso's murder revealed an alleged KSh 1.5 million payment promised to three suspects.

Investigators believed some of the money changed hands before the killing, which they say was planned and involved tracking Mutiso’s movements.
The detectives also recovered another vehicle allegedly stolen from the disputed property connected to the case.
