On October 26, 2026, Judge Tony Baumgartner sentenced the singer at Southwark Crown Court, ordering that the prison term be suspended for 12 months.
This means Brown will not serve the sentence in prison unless the conditions of the suspension are breached, including through committing another offence during the specified period.
What happened during the Chris Brown nightclub incident?
The case dates back to February 19, 2023, when Brown was in the VIP section of Tape nightclub in Mayfair with his vocal coach, Omololu Akinlolu. Music producer Abraham “Abe” Diaw was also at the venue that night.
Brown was arrested in the United Kingdom in May 2025 over the incident and was later released after pledging a £5 million security fee (approximately KSh 850 million).
He initially denied the charges against him, including attempting to cause grievous bodily harm. In July 2026, however, he pleaded guilty to a lesser charge of affray, which carries a maximum sentence of three years.
Following his guilty plea, prosecutors dropped the charges of assault, grievous bodily harm and possession of an offensive weapon.
Brown received the maximum reduction for pleading guilty at the first reasonable opportunity.
Judge explains Chris Brown's suspended sentence
During the sentencing hearing, Judge Tony Baumgartner described the nightclub incident as serious public violence, despite it lasting no more than 20 seconds.
The judge noted that Brown struck Diaw on the head twice with a tequila bottle, describing the use of the bottle as “plainly dangerous.”
Diaw was treated at St Mary's Hospital for a head injury and other injuries. He was discharged on crutches and given pain relief.
The judge also referred to Brown's previous convictions from 2009 and 2013, making it clear that the singer's international fame did not entitle him to special treatment.
However, the court also considered Brown's lengthy music career, his dependents and his charity work when determining the sentence.
After the ruling, Brown thanked the judge before leaving the dock and nodded to supporters gathered at the court as reported by YEN News.
Chris Brown's vocal coach also receives a sentence
Akinlolu, 40, who also pleaded guilty to affray in connection with the 2023 nightclub incident, was sentenced at the same court on October 26, 2026.
He received a four-month prison sentence, suspended for 12 months.
Both men therefore received suspended sentences rather than immediate prison terms over their involvement in the incident.
